Acceptance of Terms

 

By downloading, installing, or using the InflaMate app, you (or if you are under 13, your parent or legal guardian) agree to be bound by these Terms of Use. If you do not agree to these terms, you should not use the app.

App Description and Purpose

 

InflaMate is an educational financial literacy application that:

​

• Helps users understand inflation by tracking how the prices of commonly purchased items change over time.

• Visualizes price trends using clear, easy-to-read charts that show how the cost of essential items goes up or down​.

• Makes tracking simple with organized item categories and a complete history of recorded prices.

​

User Accounts and Data

​

1. InflaMate does not require account creation.

2. All data is stored locally on your device.

3. The app only collects the specific information outlined in our Privacy Policy.

4. You are responsible for the accuracy of the information you enter into the app.

Intellectual Property

​

• Ownership: InflaMate and all content, features, and functionality on the App (including but not limited to software, text, graphics, logos, images, button icons, videos, audio clips, compilations of data, and software code) are the exclusive property of InflaMate or its licensors and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws. InflaMate and the InflaMate logo are trademarks or service marks owned by us. All rights, title, and interest in and to the App and its content remain with InflaMate and its licensors.
   

• Limited License to You: Subject to your compliance with these Terms, InflaMate grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use the App on your personal device solely for your own personal, non-commercial use. This license is provided solely to allow you to use and enjoy the benefit of InflaMate's services as intended by these Terms. You do not acquire any ownership interest in the App or any content provided by InflaMate under these Terms, and all rights not expressly granted to you are reserved by InflaMate and its licensors.
   

Restrictions: You agree that you will not, and will not attempt to, do any of the following:
 

• Copy, reproduce, distribute, publicly perform or display, or create derivative works of the App or any content within it, except as expressly permitted by us in writing or allowed by law (such as making a backup copy for personal use as permitted by law).
   

• Modify, adapt, translate, reverse engineer, decompile, or disassemble any portion of the App, except to the extent that such actions are expressly permitted by applicable law notwithstanding this restriction.
   

•  Remove, obscure, or alter any copyright, trademark, or other proprietary rights notices displayed in the App or contained in any content provided through the App.
   

• Use any robot, spider, scraper, or other automated means to access the App for any purpose without our express permission, or bypass any measures we may use to prevent or restrict access to the App.
   

• Rent, lease, lend, sell, sublicense, assign, distribute, publish, transfer, or otherwise make available the App or any of its features to any third party.
  ​

• Use the App's design, look and feel, or underlying code in any manner to build a competing product or service, or in a way that exploits the App (or any portion of it) for a commercial purpose.​

Prohibited Conducts

You agree that you will NOT engage in any of the following prohibited activities in connection with using InflaMate:

 

• Illegal Activities: Using the App for any unlawful purpose, or to promote or encourage any illegal activity. You must not violate any applicable law, regulation, or court order through your use of InflaMate.

 

• Harmful Misuse: Using the App in a manner that could harm, disable, overburden, or impair the App or interfere with any other party's use of the App. This includes transmitting any viruses, malware, or any other code intended to disrupt, damage, or limit the functionality of any software or hardware.

 

• Unauthorized Access: Attempting to gain unauthorized access to the App or its related systems or networks. This includes attempting to probe, scan, or test the vulnerability of the App or to breach any security or authentication measures used by the App.

 

• Circumvention: Circumventing or attempting to circumvent any content filtering techniques or security measures that InflaMate employs, or accessing the App by any means other than through the interface provided by us.

 

• Scraping and Automation: Using any automated means (such as bots, scrapers, or spiders) to access or collect data or content from the App, or to otherwise interact with the App, without our express permission.

 

• Impersonation and Misrepresentation: Impersonating any person or entity, or falsely stating or misrepresenting your identity or affiliation with any person or entity. You must not use the App in a deceptive manner.

 

• Harassment or Abuse: Uploading, posting, or transmitting any content through the App that is defamatory, libelous, harassing, threatening, bullying, or that constitutes hate speech, or is otherwise harmful or objectionable (including content that is obscene, or promotes violence or discrimination against any person or group).

 

• Infringement of Rights: Posting or transmitting any content that infringes or violates the intellectual property rights, privacy rights, publicity rights, or other legal rights of any third party. This includes unauthorized sharing of copyrighted material or trademarked names or logos through the App.

 

• Data Mining or Exploitation: Collecting or harvesting any information from the App (including other users' data or information) without authorization, including through automated means, or exploiting any portion of the App for any commercial purpose not expressly permitted by InflaMate.

 

• Spam and Solicitation: Using the App to send any unsolicited or unauthorized advertising or promotional materials, junk mail, spam, chain letters, pyramid schemes, or any other form of duplicative or unsolicited messages.

 

• Interference: Interfering with or disrupting the integrity or performance of the App, or any data contained therein. This includes interfering with other users' experience by attempting to spread misinformation or using the App in a manner not intended by its design.

Disclaimer

InflaMate (the "App") is provided strictly "AS IS" and "AS AVAILABLE" WITHOUT ANY WARRANTIES OR REPRESENTATIONS OF ANY KIND, whether express, implied, statutory, or otherwise. The developer EXPLICITLY DISCLAIMS ALL WARRANTIES, including but not limited to:
 

1. Any implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance

2. Any warranties regarding the security, reliability, timeliness, accuracy, or performance of the App

3. Any warranties that the App will meet your requirements or expectations

4. Any warranties that any errors or defects in the App will be corrected

5. The App is designed SOLELY for educational and informational purposes. It does NOT constitute financial, investment, legal, tax, or any other form of professional advice. Any reliance you place on information obtained through the App is STRICTLY AT YOUR OWN RISK.

6. The developer makes NO CLAIMS or PROMISES about the accuracy, completeness, or adequacy of the content or functionality of the App. All financial decisions and actions taken based on information provided by the App are your sole responsibility.

Limitation of Liability

1. In no event shall the developer be liable for any direct, indirect, incidental, special, consequential, punitive, exemplary damages, or any other damages whatsoever (including, without limitation, damages for loss of profits, business interruption, loss of information, personal injury, loss of privacy, or any other pecuniary or non-pecuniary loss) arising out of or in any way connected with:

a. The use or inability to use the app
b. Unauthorized access to or alteration of your data
c. Statements or conduct of any third party on or through the app
d. Any other matter relating to the app

2. The foregoing limitations apply even if the developer has been advised of the possibility of such damages and regardless of the form of action, whether in contract, tort (including negligence), strict product liability, or any other legal or equitable theory.

Indemnification

You agree to defend, indemnify, and hold harmless the developer, its officers, directors, employees, agents, licensors, and service providers from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, fines, penalties, or fees (including reasonable attorneys' fees and legal costs) arising out of or relating to:
 

1. Your use of or inability to use the App

2. Your violation of these Terms

3. Your violation of any rights of another person or entity

4. Your violation of any applicable laws, rules, or regulations

5. Any content or information you submit, post, or transmit through the App

6. Any misrepresentation made by you

7. Any conduct, activity or action which is unlawful, harassing, defamatory, abusive, tortious, threatening, or invasive of another's privacy

8. Any technical failures or problems associated with the App
    

This indemnification obligation shall survive the termination of your use of the App and these Terms.

Termination

​

We may terminate or suspend your access to InflaMate immediately, without prior notice, for conduct that we believe violates these Terms of Use or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.

Governing Law

​

These Terms shall be governed by and construed in accordance with the laws of Thailand, without regard to its conflict of law principles. In the event of any dispute arising out of or relating to these Terms or the use of the InflaMate app, the parties agree to first seek resolution through amicable negotiations. If the dispute cannot be resolved through negotiations within 30 days, it shall be submitted to mediation under the rules of the Thai Arbitration Institute (TAI). If mediation fails, the dispute shall be finally resolved by arbitration administered by the TAI in accordance with its Arbitration Rules. The place of arbitration shall be Bangkok, Thailand, and the language of arbitration shall be English. The arbitral award shall be final and binding on both parties. Any disputes not resolved through arbitration shall be subject to the exclusive jurisdiction of the courts of Thailand.

Changes to Terms

We may modify these Terms of Use at any time. We will notify you of any changes by updating the "Last Updated" date at the top of these terms. Your continued use of InflaMate after any changes indicates your acceptance of the modified Terms of Use.
